Is not easy to be P.I. in Romania. First of all as a P.I. you have no legal access at all data, such knowing if subject has passport, criminal record etc. My P.I. colleagues and partners from other countries told me they have the possibility to obtain such data, good for them. Unfortunately, in Romania the only possibility to get these data is to "call" a connection, a friend from the Public Administration Institutions. No problem, but what if your client ask for evidence in this way? Can a Romanian P.I. give him the evidence? Legally, NO. The client must believe him and that's all what he can do. What we can do? Nothing, because the way of changing is very hard. And I'm talking about changing a law, you know ?! Almost impossible . According with the
Law 329/2003 a P.I. has the possibility to obtain data from Public Institutions or from private persons, in fact we have another law,
677 / 2001 which restrain this access. According with this law is very hard to obtain data no to mention you must let to know the subject about your investigation regarding him and his identification data. If client ask you must send him the data obtain but what if with this action you break the law? You will do it?
I am curios how a P.I. from Europe, no matter what country, manage the problem. Does he has the same problem?
